Kennaday Leavitt’s Trial Team Secures Defense Verdict in $28 Million Jury Trial

Kennaday Leavitt is proud to announce that the firm recently secured a significant victory for our health plan client in a managed-care liability case tried in Orange County Superior Court.

The case involved allegations of bad faith, specifically that the health plan had engaged in utilization management “patterns and practices” that put profits ahead of member care by unreasonably denying and delaying benefits due under the plan, refusing to cover medically necessary services, and failing to adequately investigate requests for benefits. The Plaintiff sought $28 million in damages. After a four-week jury trial, the jury returned a defense verdict on the bad faith/managed-care liability claims, rejecting Plaintiff’s argument that our client employed a pattern and practice of putting profits and financial concerns ahead of member care.

This outstanding result was achieved by Patrick Foster, Nicole Whatley, and Alexa Horner, whose skilled advocacy and strategic execution were instrumental in securing this outcome.
