KLO Wins Defense Verdict in Disability Discrimination Case

Following a three and a half week jury trial in the Sacramento County Superior Court, KLO attorneys Kelli Kennaday and Natalie Bustamante obtained a defense verdict in a case alleging disability discrimination against one of the region’s largest employers.
The plaintiff alleged she had been denied promotions by her current employer based on multiple disabilities. She claimed disability discrimination and failure to prevent discrimination, and sought lost wages, emotional distress damages and attorney’s fees. After deliberating just two hours, the jury found the plaintiff was not qualified for two of the positions she sought and had not been discriminated against on the basis of her disabilities with respect to a third. The court entered judgment in favor of the defendant on all claims.
