Kennaday Leavitt Wins Dismissal as Discovery Sanction in Pregnancy Discrimination Suit

Kelli Kennaday recently obtained a judgment of dismissal as a discovery sanction in a pregnancy discrimination lawsuit brought against her healthcare client. The plaintiff in the case was terminated for timecard fraud, but filed suit alleging she was terminated because she was pregnant. After more than two years of litigation involving numerous motions to compel plaintiff to comply with her discovery obligations, the defendants filed a motion to dismiss the case as the ultimate discovery sanction. The court granted the motion and denied plaintiff’s subsequent motion for relief based on excusable neglect. In addition to entering judgment in favor of the defendants, the court awarded defendants sanctions and court costs.
